Agreement to Terms

By accessing or using Voleur (the "Service"), operated by HWY Enigma LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

Description of Service

Voleur is a fragrance companion application and website that allows users to track their fragrance collection, discover new fragrances, receive personalized recommendations, and participate in a social community of fragrance enthusiasts. The Service is available on iOS and the web.

Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your password and account
• Promptly update your account information as needed
• Accept responsibility for all activities that occur under your account

You must be at least 13 years old to create an account and use the Service.

Subscriptions and Payments

Voleur offers both a free tier and a premium subscription ("Voleur Pro"). By subscribing to Voleur Pro, you agree to the following:

• Subscription fees are billed in advance on a recurring basis (monthly or annually) depending on the plan you select
• Payments made through the App Store are governed by Apple's terms and conditions
• Payments made through the website are processed by Stripe
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to change subscription pricing with reasonable notice

User Content

You retain ownership of content you create and submit through the Service, including reviews, ratings, photos, and collection data ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and improving the Service.

You represent that you own or have the necessary rights to post your User Content and that it does not violate any third party's rights.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Post content that is abusive, harassing, threatening, hateful, or discriminatory
• Impersonate any person or entity
• Attempt to gain unauthorized access to the Service or other users' accounts
• Use automated means to scrape, collect, or harvest data from the Service
• Interfere with or disrupt the Service or its infrastructure
• Post spam, advertisements, or promotional material without authorization
• Upload content that contains viruses or malicious code

Affiliate Links and Third-Party Services

AI-Powered Features

Certain features of the Service use artificial intelligence to provide fragrance recommendations, search results, and insights. While we strive for accuracy, AI-generated content is provided for informational and entertainment purposes and should not be considered professional advice. We make no guarantees regarding the accuracy or completeness of AI-generated recommendations.

Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by HWY Enigma LLC and are protected by copyright, trademark, and other intellectual property laws. The Voleur name, logo, and branding are trademarks of HWY Enigma LLC.

Fragrance names, house names, and related trademarks referenced within the Service are the property of their respective owners and are used for informational purposes only.

Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the fullest extent permitted by law, HWY Enigma LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.
